Scarborough Yacht Club – Online Sales Terms & Conditions

1. Who we are

Scarborough Yacht Club (“SYC”, “we”, “us”, “our”) operates this website and the online store used to sell regatta entries, clothing (such as t-shirts) and social/meal tickets.

By placing an order on this website you agree to these Terms.

2. What these Terms cover

These Terms apply to:

  • Regatta and racing entries purchased online.
  • Social and hospitality tickets (for example meal tickets and social events).
  • Club merchandise sold online (for example t-shirts, hoodies, caps).

Additional documents such as the Notice of Race, Sailing Instructions and any event-specific rules also apply to racing entries and form part of your agreement with us.

3. Placing orders and our contract with you

  • By completing the checkout you make an offer to buy the selected items or entries from SYC.
  • A contract is formed only when we send you an email confirming that your order/entry has been accepted.
  • We may refuse or cancel an order (for example if an event is full, an item is out of stock, or there is an obvious pricing error). If we do so after payment has been taken, we will issue a refund to your original payment method.

4. Prices, payment and Dojo

  • All prices are shown in pounds sterling and include VAT where applicable.
  • Payment is taken at the time you place your order using the payment options offered at checkout.
  • Card payments are processed securely via Dojo, our payment service provider.
  • Your obligation to pay is satisfied when your payment has been authorised and accepted by us.

5. Regatta and racing entries

  • By entering any race or regatta you agree to be bound by the World Sailing Racing Rules of Sailing, the RYA Prescriptions, the SYC Notice of Race, SYC Sailing Instructions and any amendments published by the race committee.
  • You are responsible for ensuring that your boat is properly insured with valid third-party liability insurance for at least the minimum amount stated in the Notice of Race.
  • You confirm that your boat complies with all safety, measurement and class rules applicable to the event.
  • The person making the entry warrants that they have authority to enter the boat and to accept these Terms on behalf of all owners and crew.

6. Cancellations and refunds

6.1 Regatta and racing entries

  • If you wish to cancel your entry, you must notify us in writing (for example by email to [regatta email address]).
  • Up to [28] days before the first scheduled race: entry fees are refundable less an administration charge of £[X].
  • [27–7] days before the first scheduled race: we may refund up to [50]% of the entry fee at our discretion.
  • [6] days or fewer before the first scheduled race: no refund will normally be given, including for non-attendance.
  • If we cancel the whole regatta before it starts, we will refund your entry fee; we are not responsible for any other costs (for example travel, accommodation, or mooring fees).

6.2 Meal tickets and social events

  • Meal and social tickets are normally non-refundable once purchased, as catering will have been ordered based on numbers.
  • If you notify us at least [7] days before the event, we may, at our discretion, offer a refund or credit if we can re-sell your ticket.
  • If SYC cancels a social event, we will refund the face value of the ticket; we are not liable for any additional costs you incur.

6.3 Merchandise (t-shirts and similar items)

  • If an item is faulty, damaged, or not as described, please contact us within 30 days of receipt. We will arrange a repair, replacement or refund in accordance with your statutory rights.
  • For non-faulty items, we may offer an exchange or credit note at our discretion, provided the item is unworn, unused and returned in a resaleable condition with any original packaging and tags.
  • You are responsible for the cost of returning items, except where the item is faulty or sent in error.

7. Delivery and collection

  • Event tickets and regatta entries are normally issued as e-tickets or email confirmations; no physical ticket may be provided.
  • Merchandise may be:
    • Collected from the club at nominated times (for example during the regatta), or
    • Posted to you if that option is offered at checkout.
  • Any delivery times stated are estimates only. We are not liable for delays outside our reasonable control.

8. Event changes and cancellation

  • We reserve the right to alter advertised schedules, courses, race formats, social programmes, catering options and other details of an event where reasonably necessary (for example due to weather, safety, staffing, or operational reasons).
  • Where an event is materially changed, we will endeavour to inform entrants as soon as practicable using the contact details supplied at booking.
  • Our maximum liability in relation to any event you have booked through this website is limited to the amount of the entry fee or ticket price that you have paid to us for that event.

9. Behaviour and safety

  • All members, visitors, competitors and guests must behave in a safe, responsible and considerate manner while on SYC premises, on the water under SYC’s control, or at any SYC-organised event.
  • We reserve the right to refuse admission to, or remove from, the club or an event any person who, in our reasonable opinion, is behaving dangerously, is under the influence of alcohol or drugs, is causing a nuisance or is otherwise in breach of club rules.
  • No refund will be given where you are refused entry or removed in these circumstances.

10. Personal data and privacy

  • We will collect and use personal data that you provide when placing an order or entry (for example name, contact details, boat details and payment information) to process your order and administer our events.
  • Card details are processed by our payment provider (Dojo) and are not stored by us.

11. Intellectual property and website use

  • All content on this website (including text, images, logos and graphics) is owned by or licensed to SYC and is protected by intellectual property laws.
  • You may view, download and print content for your personal, non-commercial use in connection with SYC events and activities only.
  • You must not copy, reproduce, modify or distribute any part of this website for commercial purposes without our prior written consent.

12. Liability

  • Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded.
  • Subject to that, to the fullest extent permitted by law, we will not be liable for:
    • Any loss of profit, loss of revenue, loss of enjoyment, or other indirect or consequential loss; or
    • Any loss or damage to boats, equipment, vehicles or other property, whether ashore or afloat, except to the extent caused directly by our negligence.
  • Participation in sailing and water-based activities is inherently risky; you and your crew take part entirely at your own risk and are responsible for your own safety, both on and off the water.

13. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in law, our practices, or the operation of our events. Any changes will apply to new orders placed after the updated Terms are posted on this website; they will not affect existing confirmed orders.

14. Governing law

These Terms and any disputes or claims arising out of or in connection with them are governed by the laws of England and Wales, and the courts of England and Wales will have exclusive jurisdiction.
